Welcome to the Association website ("Site"). This Site is provided as a resource for residents to access community information, communicate with the Association, and participate in community features, including the resident-only Discussion Board.

For purposes of these Terms, "Management Company" means the Association's property management company or managing agent designated by the Board of Directors to provide administrative and operational services on behalf of the Association.

By accessing or using this Site, you agree to comply with these Terms of Use.

1. Purpose

This Site exists to provide information and services that support the community. Features available on the Site, including the Discussion Board, are intended to encourage respectful communication and foster a positive neighborhood environment.

Use of this Site, including participation in the Discussion Board, is a privilege and may be limited or revoked in accordance with these Terms of Use.

2. Official Association Communications

The Discussion Board is provided as an informal forum for residents to exchange information, ask questions, and engage with their neighbors. It is not the official forum for conducting Association business or providing formal notice to the Association or Board of Directors.

Residents should not rely on the Discussion Board to report maintenance concerns, submit architectural requests, report covenant violations, request Association action, or communicate time-sensitive matters.

For all official Association business, residents should refer to the Association's governing documents and official communications, as well as the designated contact forms, service request tools, and other communication methods provided on the Site. These resources identify the appropriate procedures and official channels for submitting requests, notices, applications, maintenance concerns, architectural requests, covenant violation reports, and other inquiries requiring review or action by the Association.

Posts or comments made on the Discussion Board do not constitute official notice to or from the Association or Board of Directors and should not be relied upon as official communications.

Official Association notices, announcements, and records will be distributed or made available through the communication methods designated by the Association, which may include email notifications, announcements published elsewhere on the Site, official documents, meeting agendas and minutes, meeting recordings (when available), financial reports, governing documents, newsletters, and other authorized communication channels. Residents are responsible for reviewing these official communications to stay informed about Association business.

The Discussion Board is not an official record of the Association. Statements made by residents, Board members, committee members, moderators, or other participants on the Discussion Board should not be interpreted as official Association policy, decisions, approvals, commitments, or directives.

Official actions of the Association are taken only by the Board of Directors in accordance with the Association's governing documents and applicable law. Official communications of the Association are issued by the Board of Directors or the Management Company through authorized communication channels, including official notices, meeting agendas and minutes, meeting recordings (when available), financial reports, governing documents, newsletters, email notifications, and other authorized communications made available through the Site.

3. User Eligibility

Participation in the Discussion Board may be limited to homeowners, residents, tenants, or other individuals authorized by the Association. The Association reserves the right to verify a user's identity, residency, or community affiliation before granting or maintaining access to the Site or its interactive features.

Access to certain features of the Site, including the Discussion Board, requires an active user account. Account access is a privilege provided by the Association and may be limited, suspended, or revoked in accordance with these Terms of Use.

Users are responsible for ensuring that information associated with their account remains accurate and up to date.

The Association reserves the right to deactivate accounts when a user is no longer eligible for access, including when a user is no longer a homeowner, resident, tenant, or otherwise authorized community member.

4. User-Generated Content

Users are solely responsible for any content they submit, including text, photographs, files, links, and other materials.

By submitting content, you represent and warrant that:

  • You own the content or have permission to share it.
  • Your content does not infringe upon any copyright, trademark, privacy, publicity, or other legal rights.
  • Your content complies with these Terms of Use and all applicable laws.

The Association does not endorse, verify, or guarantee the accuracy of user-generated content and is not responsible for opinions expressed by users.

5. Copyright and Content License

Users retain ownership of the content they submit.

By posting content on the Site, you grant the Association a non-exclusive, worldwide, royalty-free license to use, display, reproduce, archive, and distribute that content solely for operating, maintaining, securing, and promoting the Site and its community communication services.

If you believe copyrighted material has been posted without authorization, please notify the Association so the matter can be reviewed.

6. Community Standards

Users are expected to communicate respectfully and contribute positively to the community.

The following content is prohibited, including but not limited to:

  • Harassment, bullying, intimidation, or threats
  • Personal attacks, defamatory statements, or abusive behavior
  • Profanity or offensive language directed toward others
  • Discriminatory or hateful content
  • Knowingly false or misleading information
  • Content that violates another person's privacy
  • Commercial advertising, solicitation, lead generation, or business promotion without prior authorization
  • Use of the Site for commercial purposes unrelated to Association activities without prior approval
  • Political campaign materials unrelated to Association business
  • Illegal content or activity
  • Malware, malicious links, or attempts to compromise the security or operation of the Site

The Site and its features are intended for personal community use only. Users may not use the Site for unauthorized commercial purposes, solicitation, lead generation, or promotion of products or services without prior written authorization from the Association.

Healthy discussion and differing opinions are welcome, provided conversations remain respectful and focused on ideas rather than individuals.

7. Moderation and Enforcement

To help maintain a respectful, productive, and secure community environment, the Association, acting through the Board of Directors and its authorized administrators or moderators, reserves the right, in its sole discretion, to:

  • Edit or reformat posts for readability.
  • Move posts to a more appropriate category.
  • Remove, hide, or delete any content that violates these Terms of Use or is otherwise deemed inappropriate, disruptive, misleading, or inconsistent with the intended purpose of the Site.
  • Lock or close discussions.
  • Suspend or permanently revoke a user's ability to participate in the Discussion Board.
  • Restrict or block user accounts or access to interactive features of the Site.
  • Take any other reasonable action necessary to protect the integrity, security, and intended use of the Site.

The Association is under no obligation to monitor every post, review all user-generated content, or respond to every discussion. The Association reserves the right to moderate content but assumes no responsibility for content posted by users that may be inaccurate, offensive, or otherwise objectionable.

The Association is under no obligation to provide advance notice, explanation, or an opportunity to appeal before taking moderation or enforcement actions.

8. Privacy and Account Information

To create and maintain an account on the Site, users may be required to provide personal information, including their name, property address, telephone number, and email address. This information is stored for the purpose of administering user accounts and providing access to Site features.

Only a user's name and property address may be visible to other authorized residents using the Site. Telephone numbers, email addresses, and other account information will not be displayed to other residents unless the user voluntarily chooses to include that information in content they post or otherwise make available through the Site.

Users should avoid posting confidential, personal, or sensitive information on the Site, including within the Discussion Board. While access to the Discussion Board is limited to authorized users with an account, information posted within the Discussion Board may be visible to other verified residents and should not be considered private or confidential.

Users are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account.

9. Disclaimer of Warranties

This Site is provided on an "as is" and "as available" basis without warranties of any kind. The Association does not guarantee the accuracy, completeness, availability, reliability, or uninterrupted operation of any information, feature, or user-generated content available through the Site.

The Association does not guarantee that the Site or any of its features will always be available, uninterrupted, secure, or error-free. The Association may modify, suspend, restrict, or discontinue any portion of the Site at any time.

Information shared on the Site, including content posted by residents, Board members, or moderators, is provided for general informational purposes only and should not be considered legal, financial, insurance, engineering, tax, or other professional advice. Residents should consult the appropriate professional or the Association's governing documents when making decisions that may affect their property, rights, or obligations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Association, its Board of Directors, committees, volunteers, administrators, moderators, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of, reliance upon, or inability to use the Site or any content posted by users.

11. Changes to These Terms

The Association reserves the right to modify, update, or replace these Terms of Use at any time to reflect changes in community needs, legal requirements, technology, or Site functionality.

Revised Terms become effective upon publication on the Site. For material changes, the Association may require residents to review and accept the updated Terms of Use before continuing access to resident-only features of the Site. Continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms.
